The EU has officially released the "Toys Safety Regulations"(EU) 2025/2509

On December 12, 2025, the official EU gazette officially released the "Toy Safety Regulation" (EU) 2025/2509 (referred to as TSR). This regulation will come into effect on January 1, 2026, and will be fully implemented from August 1, 2030. At that time, the current "Toy Safety Directive" 2009/48/EC (referred to as TSD) will be simultaneously abolished.

To ensure a smooth transition for member states and related enterprises, the new regulations have set a 55-month transition period. Before August 1, 2030, toys that meet the requirements of the old directive 2009/48/EC can still be placed on the EU market.

Important Update:

I. The regulatory nature changes from "directive" to "regulation" :

The current TSD, as a "directive", needs to be converted into domestic law by member states. As a "regulation", the TSR will directly apply to all EU member states.

II. The following two categories are clearly not classified as toys:

(1) Paintball equipment

(2) Books for children over 36 months old to read and educate (without entertainment value).

III. "Digital Product Passport (DPP)" replaces "EU Declaration of Conformity (DoC)" :

DPP is a specific product data containing DoC and other information that can be accessed through an electronic data carrier.Manufacturers should create and register digital product passport for their toy products before they are put on the market.

IV. Improve the for warning signs

(1) This symbol can be replaced by a black triangle icon with a yellow background and a black exclamation mark, and the height of the warning text is also specified;

(2) For toys that are not suitable for children under 36 months of age, the diameter of the pictograms on the toys should be at least 10 millimeters.

V. Digital and Intelligent Toys:

Radio toys, internet-connected toys, toys with digital elements, and toys with artificial intelligence should comply with the relevant regulations.

VI. New requirements related to physics and mechanics:

(1)Simulation food-type toys should not pose risks of swallowing or inhalation;

(2)Expanding toys should not have the risk of expanding after being swallowed and causing intestinal obstruction;

(3)Toys that are not designed to make sounds but emit repeatable sounds when operated by children, their volume should not damage children's hearing;

(4) Toys containing magnets or magnetic components, their size and strength should not pose a risk of causing intestinal perforation or obstruction.

VII. New requirements related to electronic and electrical aspects:

For electric toys that contain batteries forming small components, they should be designed in such a way that the batteries can only be accessed with tools;

When the size or nature of the toy requires it, rechargeable batteries can be designed to be inaccessible and can only be disassembled or replaced by independent professionals.

VIII. New requirements related to hygiene:

Toys with accessible aqueous materials shall be designed and manufactured in such a way as to ensure that they do not present a microbiological risk.

IX. Update Requirements Related to Chemical Safety:

1. Newly added prohibited substance category

(a)Endocrine disruption for human health category 1 or 2;

(b)Specific target organ toxicity category 1, either in single exposure or in repeated exposure;

(c)Respiratory sensitisation category 1;

(d)Skin sensitisation category 1A.

2. New specific prohibitive requirements:

(1)The intentional use of per- and polyfluoroalkyl substances (PFAS) in toys is prohibited.

(2) Toys are prohibited from containing 10 types of bisphenol substances listed in Appendix D (which may increase to 34 types in the future).

(3)Toys must not have biological killing functions or use or intentionally add biological killing products defined in Regulation (EU) 528/2012 (except for outdoor permanent placement toys and certain preservatives for residual cosmetics).

3. New cobalt (Co) exemption:

(1)In toys and toy components made of stainless steel, as an impurity in the nickel contained in the stainless steel.

(2)In toy components intended to conduct an electric current.

(3)In neodymium-based magnets used in toys if those magnets cannot be swallowed or inhaled.

4. Revise the requirements for restricted chemical substances:

Follow-up:

According to the statement released by the European Commission on October 6, 2025, the European Commission will, 12 months and 24 months after the implementation of the toy regulations, consult the European Chemicals Agency (ECHA) regarding the safety issues of "Nitrosamines and N-nitrosatable substances" as well as " Pb, Cd, Hg, and Cr(VI)".It is expected that the limits of these substances will become even stricter in the future.
