California | OEHHA Proposes Third Revision of Proposition 65 Short-Form Warnings

On October 27, 2023, the Office of Environmental Health Hazard Assessment (OEHHA) issued a notice proposing amendments to the California Proposition 65 Short-Form Warnings requirement. OEHHA is conducting a public comment period on the proposed revisions until December 20, 2023.
The following are the revisions proposed in the latest notice:
1）Add a requirement that warning labels issued should identify specific chemical substances;
2）Change " www.P65Warnings.ca.gov " to " See www.P65Warnings.ca.gov ";
3）Clarify existing safe harbor warning requirements for products sold on the internet and in catalogs;
4）Add signal word options for food warnings, clarify that short-form warnings may be used to provide safe harbor warnings for food products;
5）provide new tailored safe harbor warnings for passenger or off-highway motor vehicle parts and recreational marine vessel parts.

Relevant companies should pay attention to the proposed content and take a testing to identify high-risk chemicals in the supply chain and products.
